1. Qualifying Persons

1.1 DTR Competitions (The Promoting Company) runs several online competitions concluding with the winning of prizes in line with these terms and conditions on the website (www.dtrcompetitions.co.uk (the ‘Website’) – (any and all competitions being referred to on this site as the ‘Competition’ or ‘Competitions’).

1.2 Competitions are available for participation to persons aged 18 and over in the United Kingdom. Employees of the Promoting Company or any person connected with the Promoting Company (through family, professional or general association) are restricted from taking part in any Competition(s).

1.3 The Promoting Company reserves the right to close a user’s account at any time, if they feel the user is abusing the services, being abusive to other users or staff or they have the belief that it is not genuinely the user that is entering (falsely registered account e.g).

1.4 The Promoting Company reserves the right to refuse a User’s entry at the their own discretion.

1.5 These terms and conditions apply to any & all competitions listed on the Website (dtrcompetitions.co.uk).

2. Legal Undertaking

2.1 By taking part in a Competition the entrant (‘Entrant’, ‘you’, ‘your(s)’ and/or ‘Customer’) will be acknowledged to have legal capacity to do so, you must have read, understood and agreed to these terms and conditions and you will be bound by and any other specific requirements associated with a Competition.

2.2 All Competitions are governed by English law and all, and any disputes relating to the our competitions will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.

2.3 In the event that you take part in a Competition online via the Website, and by accepting these terms and conditions you therefore confirm that you are not infringing and/or breaching any laws in your country of residence regarding the legality of entering/taking part in our Competitions. The Promoting Company will not be held responsible for any Entrant entering any of our Competitions unlawfully. If you have any doubts at all, you should immediately leave the Website and check with the authorities in your place of residence.

3. Competition Entry

3.1 Competitions shall be entered via the Website or via Postage. Numerous Competitions can/will be operated at the same time by the Promoting Company and each Competition will have a set Prize.

3.2 The availability (number of entries & running time), as well as the pricing of each competition is at the discretion of the Promoting Company and will be presented at the point of sale on the Website. There is a requirement to pay to enter any Competition on the website, as each Competition has a set entry fee established.

3.3 In order to enter a Competition, you must register an account with us. You can register an account online. To register an account online you will be asked to provide an email address and set a password for your account in accordance with the account creation requirements. Account creation can be found by visiting “My Account” on the Website.

3.4 When taking part in a Competition online via the Website, you must follow the instructions given. To: (a) select the Competition you wish to enter and when you are ready to purchase your ticket(s) to the Competition. Each participant shall use the “Lucky Dip” feature which will provide a ticket number for each ticket that is purchased. You then provide your contact and payment details. You will need to check your details carefully to ensure that you comply with the Terms & Conditions of the Website. (b) once you have bought your Tickets, you will be registered to play the relevant Competition and when your payment has cleared we will then contact you by email to confirm your entry into the Competition. Please note that when entering online and/or by post you will not be deemed entered into the Competition until we confirm your entry.

3.5 The Promoting Company reserves the right to reject or disqualify any incomplete Entry if it is deemed that an Entrant has contravened any of these terms and conditions.

3.6 To any extent permitted by applicable law, all Entries become the Promoting Company’s property and will not be returned.

3.7 All Entrants can enter each Competition up to the maximum tickets stated in the competition description.

3.8 (a) Every account can have an unlimited number of entries, providing they are purchased on that account, by the registered buyer/user.

3.9 A Competition closes when the last ticket is sold, no more Entries after this point will be authorised or accepted.

3.10 All Entrants must register an account prior to entering and supply an email address to proceed in the Competition.

3.11 Discount codes can be used to purchase a ticket for competitions IF the discount code applies to the competition you are taking part in.

4. Promotion Periods

4.1 All Competition will run until the last ticket is purchased. Please see each Competition for details regarding prizes & starting dates.

5. Winner’s Details

5.1 The Winner may be required to show proof of identification. Any failure to meet this requirement may result in the Winner being disqualified and the Promoting Company retaining & re-drawing the Prize.

5.2 All Winners will be asked for their consent by the Promoter to provide photographs and/or pose for photographs to be displayed on social platforms and/or the. If a Winner consents to the above, the photographs may be used in any future marketing and advertisements by the Promoting Company in relation to the Competition and in identifying them as a previous Winner of a Competition.

5.3 Following receipt, verification, and confirmation of the details requested above by the Promoting Company and taking into account that the Winner has satisfied these terms and conditions, the Winners will be contacted in order to make arrangements for delivery of the Prize.

6. Competition Prizes

6.1 The Prizes are selected by all the directors of the company and are owned by the Promoting Company from the date of the Competition being displayed on the Website to the date that the Winner receives the Prize. Details of each Prize can be found on the Website on the Competitions pages, with descriptions provided for each. DTR Competitions claim no responsibility for the Prize awarded after delivery has taken place. Once the Winner receives the Prize, the Promoter does not insure the Prize. No insurance comes with the Prizes and the Promoter is not responsible for the Prize once it has been handed over to the Winner.

6.2 Delivery of the Prize to the Winner’s registered address in the United Kingdom is free. The Promoting Company has the right to and may charge the Winner delivery fees if they require the Prize to be delivered to an address outside of the United Kingdom.

6.3 Any & all expenses to collect the Prize are the sole responsibility of the Winner.

6.4 The Winner agrees that all Prizes are subject to and are dependent on the terms and conditions of the Promoting Company, Prize provider, manufacturer and/or supplier and/or anyone that is involved in the provision or delivery of the Prize to the Winner.

6.5 All Prizes must be accepted as awarded and they are non-transferable to other substitutes and cannot be used in conjunction with any additional vouchers or similar products provided on the website.

7. Storage

The Promoter can & will store the Prize free of charge for up to 30 days after notifying the Winner, unless otherwise specified on the Competition Description, at the end of which time the Prize will be delivered to the Winner. If the Prize needs to be stored by the Promoting Company for more than 30 days then this shall be at the cost of the Winner where such cost will need to be paid in full to the Promoting Company before the Winner receives the Prize.

8. Winners’ Personal Data

8.1 In the event of gaining the Winner’s consent, the Winner may be asked to have their photo taken by the Promoting Company for promotional purposes on Social Media and/or the Promoting Company’s Website.

9. Limits of Liability

9.1 The Promoting Company provides no representations, warranties and/or assurances of whatever nature as to the quality, suitability and any particular purpose of any of the goods or services advertised, offered and provided as Prizes. Except for liability for death or personal injury caused by the complete negligence of the Promoting Company and for any & all fraudulent misrepresentations and/or for all events or circumstances to the extent that they cannot be excluded or limited by law. The Promoting Company shall not be liable for any loss suffered or sustained to person or property once the product/prize has been delivered and accepted by the Winner/user.

9.2 The total maximum liability of the Promoting Company to you shall be limited to the amount that you have paid to enter our competitions within the period of signing up to our Website.

10. Electronic Communications

No responsibility will be claimed or taken by the Promoting Company for any failed, partial or garbled computer transmissions, be it computer / tablet / mobile or any other method of electronic communication. The Promoting Company shall use its reasonable endeavours to award the Prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error, the Prize is awarded incorrectly, the Promoting Company holds the right to reclaim the Prize and award it to the correct Entrant, at its sole discretion and without any admission of liability. The Promoting Company will use its own website provider to ensure that the software and Website(s) used to run its Competitions performs correctly and accurately across the latest versions of all common internet, tablet and mobile browsers.

11. Data Protection Notice

Any personal data that is supplied to the Promoting Company or authorise the Promoting Company to access from a third party, for example, a credit card company, will be used by the Promoting Company to run the Competition and award Prizes where applicable. In order to process, record and use your personal data the Promoter may offer it to (i) any credit card company whose name you give. In order to process, use, record and disclose your personal data the Promoting Company may be required to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.

12. Validation

12.1 The Promoting Company holds the right not to award a Prize if there is reasonable suspicion of the occurrence of fraud in relation to a Competition.

12.2 The Promoting Company may, at its total and sole discretion, award a Prize to a person whom it is satisfied is the fully authorised representative of the Winner acting under a lawfully executed power of attorney or other equivalent authorisation.

13. Your account

13.1 You must always keep your account password secure and secret and take steps to prevent it being used without your permission. You must (a) memorise your password and never tell it to anyone, (b) write your password down and store it in a safe location of which only you can access, (c) destroy any communications from the Promoting Company in relation to your password as soon as you have read them, (d) avoid using a password that is easy to guess, try using special characters, numbers and/or upper & lowercase letters (e) log off or quit from your account when not using it, and (g) keep your password or other access information secret. We will never ask for your password to be provided as authentication, verification, or any other methods of proving identity.

13.2 Your password and access details are personal to you and should not be given to anyone else and/or used to provide shared access e.g. over a network. You must use a password which is specific to your account, and not used by anybody else.

13.3 You must contact the Promoting Company immediately if you believe or know that somebody apart from yourself has used your account and given instruction with regard to it without your permission.

13.4 If you forget your password, you can reset it by following the instructions on the Website.

14. Changes

14.1 DTR Competitions may review our terms and conditions every now and again and will post the most recent version on our Website as soon as possible after the revised terms and conditions become effective and are agreed upon by any/all company directors. Please check this page periodically to confirm that you understand the terms and conditions that apply at that time. When continuing to access and/or use the Website after the revisions come into effect, you agree to be bound by the revised terms and conditions. We may also update and change the Website and Competitions from time to time to, amongst additional reasoning, reflect changes to our offering, Website, and IT systems.

15. Unauthorised use and expiry of your debit card

15.1 Should you inform your bank (or building society) that your debit or credit card has been used without your permission in order to enter a Competition, and your bank (or building society) asks the Promoting Company to return the labelled amount to your bank (or building society) account, the Promoting Company may suspend your account and ask you to contact the Promoting Company. The Promoting Company claims no responsibility and will have no liability for any chargebacks you may wish to request.

15.2 If your debit or credit card is due to expire, the Promoting Company will use professional efforts to return any funds held in your account to your debit card before midnight on the day of expiry. If it is not able to do so, the Promoting Company will use all efforts to alert you of this and you should, given the circumstances, contact the Promoting Company to arrange another appropriate way for the Promoting Company to return the funds to you.

16. Use of the Website

16.1 You agree that (a) the Website, the Competitions and/or draws are for your own personal use, and (b) you are only allowed to use your account and the Website, to enter Competitions as set out in these terms and conditions.

16.2 You also agree that you will only use your account, enter Competitions and/or use the Website in an appropriate, respectful, and lawful manner. You will not (a) receive, access and/or transmit any content which is obscene, pornographic, threatening, racist, menacing, offensive, defamatory, in breach of confidence, in breach of any intellectual property right (including, without limit, copyright) and/or otherwise objectionable and/or unlawful, (b) knowingly and/or recklessly transmit any content (including, without limit, viruses) through the Website and/or the Promoting Company’s software and IT systems which will cause, or be likely to cause, (i) detriment and/or harm, in any degree, to the Website, the Promoting Company’s software and IT systems owned and/or operated by the Promoting .

16.3 You additionally agree to indemnify the Promoting Company against any or all costs, losses, damages and expenses which we may suffer and/or incur arising out of and/or in relation to any claim, legal proceeding and/or demand made by any third party due to and/or arising out of your unlawful, wrongful and/or negligent access and/or use of your account.

16.4 There is no guarantee that the Website will display correctly on all devices it can be viewed on due to frequent updates. The Promoting Company will strive to ensure that the Website is accessible on all devices as frequently as possible.

16.5 The Promoting Company is the owner of all the copyright and other intellectual property rights in respect of the Competitions, and the Website and you will not acquire any rights in any of these at any point.

16.6 You must not copy, disclose, transmit and/or make available and remove or change any material available on the Website.

17. Discretion

The exercise by the Promoting Company of any discretion provided for in these terms and conditions will be final and binding.

18. General

18.1 These terms and conditions constitute the complete agreement in place between you and the Promoting Company regarding the subject of the terms and conditions and replace any other prior agreements.

18.2 A person who is not a party to these terms and conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 (as amended or re-enacted from time to time, and any subordinate legislation made under that act) or otherwise to enforce any provision of these terms and conditions.

19. Anti-Money Laundering

DTR Luxury Competitions Ltd complies with the UK anti-money laundering regime requirements that are set out in the Proceeds of Crime Act 2002 (POCA) (as amended by the Serious Organised Crime and Police Act 2005 (SOCPA)), the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (MLR 2017) and the Terrorism Act 2000.
